Terms and Conditions
As of: October 2026
This is a translation for your convenience. Only the German version is legally binding.
1. Scope and contracting party
These terms apply to all contracts about VZCTRL licenses concluded on this website. The contracting party is:
mo-tion interactive
Handelskai 265
1020 Wien, Austria
E-mail: contact@mo-tion.at
Deviating terms of the customer do not apply. Consumers within these terms are persons within the meaning of § 1 KSchG (Austrian Consumer Protection Act).
2. Subject of the contract
The customer receives a non-exclusive, non-transferable right without time limit to use the software VZCTRL within the scope of the chosen edition (section 6). The software itself is not sold; all rights in it remain with mo-tion interactive.
3. Conclusion of the contract
The presentation of the licenses on the website is not a binding offer. An account is needed to buy. By clicking the payment button on Stripe’s payment page, the customer makes a binding offer. The contract is concluded with the successful payment and the provision of the license key. The customer receives the invoice by e-mail from Stripe.
4. Prices and payment
All prices are final prices in euros including 20% VAT. The license is paid once; there are no recurring fees. Payment is made through Stripe with the payment methods offered there.
5. Delivery
The license key is shown on the confirmation page right after payment and is available in the dashboard at any time afterwards; the download of VZCTRL is there as well. Access to the Git repository (Agency edition) is usually set up within 24 hours on working days.
6. Scope of the license
Individual:
- Use by one natural person on up to two devices at the same time
- Commercial use allowed
- No passing on, renting or sublicensing to third parties
Agency:
- Use within one organisation by any number of persons on any number of devices
- Access to the Git repository with the source code
- Changes to the source code for own purposes allowed; no passing on of the source code or changed versions to third parties
The license is activated online once and checked regularly afterwards; without an internet connection VZCTRL remains usable for 30 days after the last successful check. Updates of version 1 are included at no extra charge.
7. Right of withdrawal for consumers
Consumers generally have a right to withdraw from distance contracts within 14 days of conclusion (§ 11 FAGG). For digital content not supplied on a physical medium, this right expires as soon as we have begun performing the contract after the consumer has expressly agreed that we begin before the withdrawal period ends and has acknowledged that they thereby lose the right of withdrawal (§ 18 (1) 11 FAGG).
The customer gives this consent in the checkout before paying; without it no purchase is possible. As the license key is provided immediately after payment, the right of withdrawal expires with the payment. The confirmation of the consent is included in the invoice. You can check VZCTRL beforehand with the free 14-day trial.
8. Warranty
The statutory warranty provisions apply, for consumers in particular the Consumer Warranty Act (VGG). Towards businesses the warranty period is twelve months from delivery. We remedy defects through support or a corrected version.
9. Liability
We are liable without limitation for intent and gross negligence and for personal injury. We are not liable for slight negligence, except for personal injury. Towards businesses, liability for lost profit, indirect damage and loss of data is excluded. The customer is responsible for regularly backing up their data. Liability under the Product Liability Act remains unaffected.
10. Data protection
Our privacy policy describes how we process personal data.
11. Applicable law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules. For consumers, the mandatory protective provisions of the state of their habitual residence remain unaffected. The place of jurisdiction for businesses is the competent court in Vienna; for consumers § 14 KSchG applies.
12. Final provisions
Should a provision of these terms be invalid, the remaining provisions remain valid. Towards businesses, the invalid provision is replaced by a valid one that comes closest to its purpose.
